By accessing our website, engaging our services, or purchasing any property from us, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you do not agree with any part of these terms, you must not use our services or website. Your continued use of our services constitutes acceptance of any modifications to these terms.

2.1 Real Estate Development

Atmiya Developers specializes in residential real estate development, including but not limited to:

  • Luxury bungalows and residential complexes
  • Apartment complexes and housing projects

  • Project management and construction services

3. Booking and Payment Terms

3.1 Property Booking Process

Property booking requires:

  1. Submission of a completed booking form
  2. Payment of booking amount as specified
  3. Verification of identity and financial documents
  4. Signing of the booking agreement

3.2 Payment Schedule

Payment terms vary by project and will be clearly specified in your booking agreement. Generally, our payment structure includes:

  • Booking amount: As specified per project
  • Down payment: Typically 10-20% of total property value
  • Construction-linked payments: As per project milestones
  • Final payment: Upon possession

3.3 Price Variations

Prices are subject to change based on market conditions, government regulations, and project modifications. However, once you have made a booking with the required payment, the agreed price will be honored for your specific unit.

4. Cancellation and Refund Policy

4.1 Client-Initiated Cancellation

Clients may cancel their booking under the following conditions:

  • Written notice must be provided
  • Cancellation charges as per the booking agreement will apply
  • Refund processing may take 45-90 working days
  • Interest on the amount paid is not payable

4.2 Company-Initiated Cancellation

Atmiya Developers reserves the right to cancel bookings in cases of:

  • Non-payment of installments as per schedule
  • Breach of terms and conditions
  • Regulatory or legal issues affecting the project
  • Force majeure events

4.3 Refund Process

All refunds will be processed as per the terms mentioned in the individual booking agreement and subject to applicable deductions for administrative charges, marketing costs, and other expenses incurred.

5. User Responsibilities

5.1 Information Accuracy

Clients must provide accurate and complete information during the booking process. Any false or misleading information may result in cancellation of the booking.

5.2 Compliance with Laws

Clients must comply with all applicable laws, regulations, and society rules. This includes but is not limited to:

  • Foreign Exchange Management Act (FEMA) regulations for NRI clients
  • Income tax obligations
  • Local municipal and society regulations
  • Environmental and safety guidelines

5.3 Payment Obligations

Timely payment as per the agreed schedule is mandatory. Delays in payment may result in penalty charges and potential cancellation of the booking.

6. Property Information and Modifications

6.1 Project Details

All project details, including floor plans, amenities, and specifications, are indicative and subject to change based on:

  • Regulatory requirements
  • Technical feasibility
  • Safety considerations
  • Environmental clearances

6.2 Possession Timeline

Possession dates are estimated and may vary due to factors beyond our control, including but not limited to weather conditions, regulatory approvals, and force majeure events.

6.3 Common Areas and Amenities

Common areas and amenities are provided as per the project plan and are subject to completion and regulatory approvals. The company reserves the right to modify amenities based on practical considerations.

7. Limitation of Liability and Disclaimers

7.1 Limited Warranty

We provide construction warranty as per industry standards and local regulations. This typically includes structural warranty and defect liability period as specified in the sale agreement.

7.2 Force Majeure

Atmiya Developers shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including:

  • Natural disasters
  • Government actions or policy changes
  • Labor strikes or material shortages
  • Pandemic or health emergencies
  • War, terrorism, or civil unrest

7.3 Limitation of Damages

Our liability is limited to the actual amount paid by the client. We are not liable for indirect, consequential, or punitive damages.

8. Privacy and Data Protection

We are committed to protecting your privacy and personal information. Our data collection and usage practices are governed by our Privacy Policy, which forms an integral part of these terms. Key points include:

  • Collection of necessary personal and financial information
  • Use of data for project-related communications and legal compliance

9. Intellectual Property Rights

9.1 Company Property

10. Termination

Either party may terminate the agreement under the conditions specified in the individual booking agreement. Termination may result in forfeiture of amounts paid, subject to the terms of the agreement.

11. Governing Law and Jurisdiction

These terms are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Bhuj, Kachchh, Gujarat, India.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
